Madras High Court Upholds Muharram Procession Amid Controversy

On July 15, the Court accepted a petition from Thameem Sindha Madar, who raised concerns about conflicting views among Muslim devotees in Ervadi town, Tirunelveli regarding the traditional Muharram procession. This procession, known as Santhanakoodu and Kuthirai Pancha, involves drumming and music. The petition stated that this year, another group identifying as Thowheed Jamath opposed these rituals, claiming they deviated from pure Islamic practice and could corrupt devotees.

Justice GR Swaminathan remarked that it is the State’s responsibility to address fundamentalist threats when they endanger citizens’ fundamental rights. Despite the petitioners seeking intervention from district authorities to prevent interference, they were instead advised to abstain from the rituals due to potential law and order issues.

The court disagreed with the authorities, asserting that they had taken the easier path by allowing one group to obstruct another’s religious practices. Consequently, the court ruled in favor of the petition, instructing local police to ensure the safety of the procession. It also advised dissenting parties to refrain from participation and remain indoors if they opposed the rituals.
