Allahabad High Court says no demolition as on date concerning petitioners Ali Bin Saif and Syed Kaif Hasan, following an urgent hearing on Friday. Represented by advocates Ali Bin Saif and Syed Kaif Hasan, the petitioners challenged a demolition order issued by the Development Authority on 10.10.2024. They argued that the order defies a Supreme Court directive dated 17.09.2024, which instituted a nationwide moratorium on demolitions pending further orders.

The petitioners emphasized the threat of immediate demolition by filing a supplementary affidavit, expressing apprehension that such actions would violate the Supreme Court's interim protection. They highlighted the Development Authority's actions as contradictory to the ongoing restrictions mandated by the apex court.

Responding to these claims, the counsel representing the Development Authority clarified that the document issued was merely a notice, not an enforceable demolition order. The counsel also orally assured the High Court that no coercive measures would be taken against the petitioners until the next date of hearing.Noting the submissions from both sides, the Allahabad High Court recorded that, as of now, no active demolition order exists against the petitioners.

The Court instructed the Development Authority’s counsel to obtain further instructions from the relevant authorities in the meantime. The matter has been scheduled for a detailed hearing on 07.11.2024.This interim order underscores the Allahabad High Court’s commitment to upholding the Supreme Court’s protective order, offering the petitioners temporary relief until further proceedings.
